According to the amendment of the Act on chemical substances and their mixtures, entities releasing (e.g. for intra-Community acquisitions for use within a business) hazardous mixtures for consumer and professional use are obliged to register in the national ELDIOM system and to provide information on such a mixture in electronic form by introducing a safety data sheet.
Notifiers shall comply to the new notification system according to the following deadlines:
- from 1 January 2020: mixtures for consumer use,
- from 1 January 2021: mixtures for professional use,
- from 1 January 2024: mixtures for industrial use.
The definitions in EU legislation that define which categories of product should be considered as intended for particular purposes are rather laconic and self-referential:
- Mixture for consumer use means a mixture intended to be used by consumers - (e.g. for entertainment or in households),
- Mixture for professional use means a mixture intended to be used by professional user,
- Mixture for industrial use means a mixture intended to be used at industrial sites only - (e.g. car paints).
Failure to comply with the obligation may result in financial penalties on the Company (also under Code of Conduct on Offences). In order to verify whether a mixture can be considered hazardous, the safety data sheet ( section 2) shall be analyzed.
