The Amendment of the Act on specific solutions related to the prevention, counteraction and eradication of COVID-19, other infectious diseases and resulting from them crisis situations, as well as some other legal acts expands the list of documents whose validity will be extended for 30 days from the day following the cancellation of the epidemic emergency or epidemic status.

The extended list of documents entitling foreigners to legal residence includes:

  • National visa issued by other Schengen member state,
  • Residence permit issued by other Schengen member state,
  • Visa-free traffic,
  • Long-term visa issued by other European Union member state which is not Schengen state - if according to the provisions of the European Union law, it allows to stay in the territory of Poland,
  • Residence permit issued by other European Union member state which is not Schengen state - if according to the provisions of the European Union law, it allows to stay in the territory of Poland,
  • Schengen visa,

The previous version of the act included the following list of the documents extended automatically for 30 days after cancellation of the epidemic status:  

  • National visas issued by the Polish consulates
  • Residence permits issued by the Polish Provincial Offices
  • Work permits
  • Declarations of entrusting work to a foreigner.

In case any of the above-mentioned documents expires during the epidemic emergency or epidemic status introduced due to COVID-19, the foreign national's stay in Poland shall be considered legal up to 30 days from the day following the cancellation of one of the above-mentioned states.
